To which voyage do passenger rights apply?
The rights of passengers in shipping are generally valid if:
- the port of embarkation is within the EU
- the port of disembarkation is located in the territory of a Member State, provided that the service is provided by a company established in the European Union, or
- the voyage is a cruise for which the port of embarkation is in the territory of a Member State.
- Cruises are only partially covered; not all provisions of the regulation apply here.
Which voyages are not included?
- Voyages on ships which are licensed to carry a maximum of 12 passengers, whose officially prescribed minimum crew consists of a maximum of three persons or which cover a total distance of less than 500 m ( one way).
- Excursion or sightseeing trips and ships without mechanical propulsion.
The legal basis is Art. 2 of Regulation (EU) 1177/2010.
Responsibility of the apf in waterborne transport
The apf is responsible if the cruise is from, to or within Austria or if the company concerned has its registered office in Austria.
The apf is NOT responsible for proceedings concerning international cruises.
In such cases, those affected are referred to the competent authority of the respective member state.
