Conditions of carriage
Pursuant to Section 22b (1) and (2) EisbG, railroad undertakings and the transport association organization companies must notify Schienen-Control GmbH of all conditions of carriage for the provision of passenger rail transport services on main lines and networked branch lines prior to their publication.
Obligations to the Schienen-Control
Pursuant to Section 5 (4) of the Federal Act on Agency for Passenger Rights , Schienen-Control GmbH is authorized to verify compliance with the requirements of the Federal Act on Agency for Passenger Rights, Regulation (EU) 2021/782, the Austrian Climate Ticket Act (EisbBFG) and Annex 1 of the Ordinance on the Introduction of the Climate Ticket.
For this purpose, the companies concerned must provide all necessary information, submit documents and grant access to their premises insofar as this is necessary for the inspection.
Pursuant to Section 8 (2) of the Federal Act on Agency for Passenger Rights , the companies must provide information on customer satisfaction at the request of Schienen-Control GmbH, provided that the companies have the relevant data or information.
Information about the apf
Railroad companies, inner-city transport operators, ticket vendor, tour operators, station operators and transport associations are legally obliged to inform passengers of the contact details of the Agency for Passenger Rights . This information must be easily accessible on the respective websites and in the stations. The contact details of their own complaints office must also be provided, if available.
The companies are also obliged to refer to the apf in their letter when responding to a complaint.
This results from Section 5 (2) of the Federal Act on Agency for Passenger Rights.
