The apf recommends that persons in possession of an annual pass regularly check whether they are participating in the compensation procedure and whether the route and account data are still up to date.
What passenger rights apply to weekly tickets?
Passengers in possession of a weekly ticket who are repeatedly affected by delays or train cancellations during the period of validity are entitled to compensation for delays.
For weekly tickets, thecompanies and transport associations canset the amount of compensation themselves.
The ÖBB-Personenverkehr for example, compensates a flat rate of 1.50 euros per delay of more than 20 minutes.
The delays must be confirmed to ÖBB-Personenverkehr .
For weekly tickets of ÖBB or a transport association, this is done via the ÖBB website at: ÖBB confirmation of delay. Confirmations are also available at all ÖBB ticket counters up to 60 minutes after train arrival or up to two days after the journey from ÖBB customer service 05-1717.
What passenger rights apply to monthly tickets?
The provisions for annual tickets apply to monthly tickets (see below).
This means that a flat-rate punctuality rate also applies to monthly tickets. If the punctuality rate falls below 95 percent on regional services , passengers are entitled to compensation. In contrast to the regulation for annual tickets, compensation for monthly tickets must be actively requested from the train-company. The train-companies are obliged to publish on their websites the punctuality rate achieved punctuality rate achieved over the last 18 months on their websites to enable passengers to check their entitlement to compensation.

The companies can set a minimum compensation amount, which may not exceed four euros per ticket. They can refuse to pay compensation below this amount.

What passenger rights apply to annual tickets?
Persons in possession of annual tickets will NOT receive compensation for a single delayed or canceled train. Compensation is based on a statutory punctuality level, below which a flat-rate compensation is paid.
For annual tickets that are valid in a transport network, the punctuality rate is used for the entire area of validity. This applies specifically to KlimaTicket Austria and the regional KlimaTickets of the transport associations. In the case of route-based annual tickets, the degree of punctuality is used for the specified route. If the degree of punctuality isnot met in at least one month of validity, those affected will receive a refund of ten percent of the fare for that month. In the case of annual tickets that cover more than one mode of transport, the rail portion is taken into account. The compensation is paid automatically by the respective rail company at the end of the validity period of the annual ticket . All claims for compensation lapse if they are not asserted with the railroad company within one year of the expiry of the annual ticket.
Example calculation:
With 494.12 euros rail share (= annual price share of ÖBB-Personenverkehr) of the ticket price and a shortfall of the valid punctuality level in three months, the passenger receives 12,36 euros at the end of the period of validity
494.12 / 12 = 41.17 (proportionate costs for one month)
10% of 41.17 = 4.12 (refund amount per month of delay)
4.12 x 3 = 12.36 (refund amount for all three months of delay)

This makes it possible to check punctuality and compensation claims yourself at any time.
The rail companies receive the data on punctuality levels from the infrastructure managers. In the ÖBB infrastructure punctuality data relevant for compensation, a train is considered late if it is 5 minutes and 30 seconds late or more. Canceled trains and so-called unplanned rail replacement services (e.g. due to line closures, damaged trains), about which passengers cannot or can hardly be informed in advance, are also recorded as unpunctual.
Transport on scheduled bus services (buses), urban transport (e.g. Wiener Schnellbahn) and on non-networked branch lines (e.g. IVB, NÖVOG) are excluded from the compensation.
The companies can set a minimum compensation amount, which may not exceed four euros per ticket. The companies can refuse compensation for lower amounts.

Participation in the compensation
What compensation is available for annual travelcards issued by transport associations?
Annual season tickets for the transport associations
All regional rail companies in Austria are subject to a statutory punctuality rate of at least 95 percent for trains. At ÖBB-Personenverkehr this applies to: Regional train (R), Regional Express (REX), cityjet express (CJX) and S-Bahn (S). If this level of punctuality is not achieved in at least one month, those affected with a route card will receive a lump-sum compensation at the end of the validity period (see calculation example above).
When concluding a contract for an annual season ticket, the transport associations request consent to participate in the compensation procedure or to consent to the use/forwarding of personal data.
(exception: Verkehrsverbund Ost Region, where no separate consent is required).
Upon approval, the transport association will send the data relevant for compensation to the respective railroad company.
A personal access code for registration should be sent in writing after purchasing the annual pass.

Regional KlimaTickets from the transport associations
The regional Klimaticket offers of the seven transport associations in Austria are to be distinguished from KlimaTicket Austria.
(KlimaTicket MetropolRegion, KlimaTicket Region, KlimaTicket Tirol, Kärnten Ticket, KlimaTicket OÖ, KlimaTicket Salzburg, KlimaTicket Steiermark, KlimaTicket VMOBIL)
This form of annual ticket is also subject to a statutory punctuality rate of 95% for regional trains. If this level is not met in a month of validity, holders of regional climate tickets will automatically receive a refund of at least ten percent of the monthly fare for the rail portion from the respective rail company after the end of the period of validity (see calculation example above; in the case of ÖBB-Personenverkehr , holders of the KlimaTicket receive 10 percent of the pro rata compensation base per month).

To claim compensation from ÖBB-Personenverkehr , you must register at https://www.oebb.at/Fahrgastrechte or at an ÖBB ticket counter or service center. The personal access code for the registration will be sent after the purchase of the annual ticket.

How does compensation work for KlimaTicket Austria?
Klimaticket Austria is a product of One Mobility Ticketing GmbH, a wholly owned subsidiary of the Federal Ministry for Climate Action, Environment, Energy, Mobility, Innovation and Technology(BMK).
If the punctuality level of 93 percent for regional and long-distance trains, which is legally stipulated for all railroad companies in Austria, is not achieved in at least one month, those affected will receive compensation from the respective railroad company at the end of the validity period of the annual ticket.
In the case of ÖBB-Personenverkehr , this applies to: Regional train (R), Regional Express (REX), cityjet express (CJX), S-Bahn (S), Eurocity (EC), Intercity (ÖBB-IC or IC), ICE,
Railjet (RJ), Railjet Xpress (RJX) or D train (D)
Affected persons are entitled to ten percent of the compensation basis in one month. The compensation basis is the ticket price minus the price shares for transportation on scheduled bus services (buses), urban transport and non-networked branch lines. The amount of the compensation basis can be found at klimaticket or in this document. For ÖBB-Personenverkehr this is currently 494.12 euros, for WESTbahn 19.07 euros.
For each month in which the statutory punctuality rate of 93 percent is not achieved, holders of the KlimaTicket Österreich will receive 4.12 euros in compensation from ÖBB-Personenverkehr .
For all other rail companies, the maximum compensation amount is less than four euros. Amounts under four euros can be excluded from payment by the rail companies.
Calculation example compensation KlimaTicket Austria:
ÖBB-PV share of KlimaTicket Austria: EUR 494.12 - punctuality rate was not achieved in two months (assumption)
494.12 / 12 = 41.17 (cost share of KlimaTicket Austria per month)
10% of 41.17 = EUR 4.12 (basis for compensation per month of delay)
EUR 4.12 x 2 = EUR 8.24 (if the punctuality rate of 93% was NOT achieved in two months)

In order to assert a claim for compensation, it is necessary to allow One Mobility GmbH to pass on data to the rail companies.
Consent can be given directly in the KlimaTicket at klimaticket under "My tickets". It may take a few days or weeks for the data to be forwarded to the rail companies. You will then need to register with ÖBB-Personenverkehr . You can register with ÖBB-Personenverkehr via the website at https://www.oebb.at/Fahrgastrechte. After clicking on the "KlimaTicket" tile, the corresponding annual pass number and password must be entered. If you do not yet have the password, you will need to register for the first time.
For all other rail companies, the maximum compensation amount is less than four euros. Amounts under four euros can be excluded from payment by the rail companies.
