Performance reductions in night train services

Night trains are a comfortable and environmentally friendly way to travel long distances while you sleep. But unfortunately, not everything always runs smoothly. From delays to poor facilities, various problems can affect the journey. In such cases, it is important to know what rights you have as a passenger and how you can get support.

Downgrading - sleeping car is not carried

Imagine you have booked an expensive sleeper compartment, but when you arrive at the station the sleeper carriages you booked are missing. A downgrading of this kind represents a clear reduction in service. In such cases, passengers are entitled to a partial refund of the ticket price when they start their journey. The rail company must at least refund the difference to the booking class in which you were transported. A breakdown of the booking classes and the differences can be found on the ÖBB-Personenverkehr website.

In future, the composition of the fare must be stated in the booking confirmation or on the ticket. This will provide passengers with more precise information about the amount of the refund.

Night train is late

Delays can disrupt your entire travel plan. If the night train is severely delayed, you are entitled to compensation depending on the length of the delay. For example, you are entitled to 25 percent of the fare for a delay of one hour or more and 50 percent for a delay of two hours or more.

Vermin on the train

Bugs in sleeping cars are a serious problem that can massively affect the comfort and hygiene of travel. There are frequent reports of passengers being plagued by bedbugs and other pests. If you are affected by such an incident, you should report this immediately to the train crew and submit a written complaint including evidence (photos as proof, certificate) to the railroad company. In such cases, you may be entitled to compensation for damages or pain and suffering. This must be checked on a case-by-case basis.

Heating/air conditioning system is defective

A functioning heating or air conditioning system is particularly important on night trains. Defects can lead to uncomfortable temperatures in the compartment, which can significantly disturb your sleep. Here too, the problem should be reported to the train crew. In such cases, you may also be entitled to a partial refund of the ticket costs if sleeping comfort has been significantly impaired.

Support from the apf

In all these cases of reduced benefits, those affected can contact the apf free of charge. The apf helps to enforce legal claims and provides advice. This applies if complaints to the train company were not successful or were not answered within the statutory period of one month.
