Bus: Intercitybus - Passenger rights and claims

from Jürgen Vogl

As these routes are more than 250 kilometers long and are bus services, the Bus Passenger Rights Regulation (Regulation (EC) No. 181/2011) should actually apply here. However, ÖBB-PV intercity buses are regarded as a supplement to rail transport, which means that the Rail Passenger Rights Regulation (Regulation (EC) No. 1371/2007) applies instead of the Bus Passenger Rights Regulation, as is the case for all other long-distance buses. This gives passengers considerably more rights, e.g. with regard to compensation for delays in arrival or reimbursement of the fare from 60 minutes delay (according to bus passenger rights only from 120 minutes)

Notes/recommendations from apf for your trip:

  • When booking the Intercity bus, no seat reservation is included. However, as buses only have a limited number of seats, apf recommends that you make a reservation so that you can travel in any case if the bus is very busy.
  • Please note that if you use different means of transport (e.g. bus and train or bus and flight), the transport-specific passenger rights apply. This means: If you miss your connecting train or flight due to a delayed bus journey, for example, you are not entitled to compensation/refund for the delay, as the Bus Passenger Rights Ordinance applies. However, you may be able to assert your claims against the bus company under civil law (compensation).
